Accutane is a drug that has benefits with great risks of harm. It was highly effective at treating sever acne but can cause serious birth defects when given to pregnant women. Normally, prior to being allowed onto the market place, prescription drugs undergo chemical analysis, laboratory testing, and clinical trials, by the FDA to make sure the drug is safe. The struggle of law dealing with drugs that benefit many but harm a few is a dedicating balancing of interest. It is also a question of public policy. Do we want to prevent drugs that can help many from entering the market balance when they may harm a few. Can we devise a scheme to limit the harm if we warning the public. Can we warn doctors that prescribe these drugs and what do we do when the fail to do their jobs correctly? Do is to blame when the medical practitioner fails to do his or her job correctly. These are policies questions that our society must address. These are also questions that legal system has to address when lawsuits are brought by those injured by drugs like Accutane.

Inflammatory Bowel Diease

In a tort related case, the makers of Accutane are being sued by a lady who was prescribed Accutane since the age of 15 years old and developed Inflammatory Bowel Diseas (IBD). Her lawyer asserted that Accutane’s brochure was misleading and never mentioned the risk of developing Inflammatory Bowel Disease. He further stated that according to internal documents, the manufacture of Accutane knew that one of the side of affects of Accutane was IBD yet failed to warn. He defense the company relieved on their classic argument that it was the victims two dermatologist who are to blame and that the company provided the proper warnings. The defense argued that the warning was adequate, appropriate, accurate and that it was the doctor who failed to to communicate the risk of the drug to their patients. We will have to keep our eyes on this case in New Jersey as its gets to the jury in the days to come.

Failure to warn

Thousands of lawsuits have been filed against the manufacture of Accutane for their failure to warn consumers about the drug’s side effect. This is a classic case of product liability. The theories adjusted in these lawsuits is that Accutane can cause severe inflammatory bowel disease, birth defects, suicide, depression, psychiatric disorders, lupus and the potential for violence in people taking Accutane. Attorneys are alleging that the manufacture of Accutane knew about these side effects and nevertheless sold the drug anyways without warning the public.

$25 Million Accutane Judgment

A jury awarded a New Jersey man $25 million dollars against the makers of the Accutane, Hoffmann-La Roche. The man had used Accutane for acne and developed inflammatory bowel disorder. The jury took just three hours to render its decision. The gentlemen also received $159,000 for past medical expenses. Most of the damage awarded was for punitive damages. Hoffman-La Roche has stopped making the drug but that has not stop the lawsuits as more and more people begin to realize that some of the medical conditions were caused by the Accutane.
